Telecommunications use of Public Rights-of-Way

Telecommunications use of public rights-of-way within the city shall be consistent with Chapter 112 of the City Code of Ordinances, state and federal law, including F. S. §§ 337.401, 362.01, and 337.29(3), and the city's home-rule authority in accordance with the provisions of the Telecommunications Act of 1996 and the Advanced Wireless Infrastructure Deployment Act. Telecommunications facilities, include all cables, conduits, converters, splice boxes, cabinets, handholes, manholes, vaults, equipment, drains, surface location markers, appurtenances, and related facilities located, to be located, used, or to be used, but a telecommunications service provider in the public rights-of-way of the city and used or useful for the transmission of telecommunications services.

A telecommunication service provider that desires to erect, construct, install, maintain, repair, expand or use any telecommunication facilities in, or under public rights-of-way in the city shall first register with the city in accordance with this ordinance. As to toll service providers, such registration shall be accepted by the city as a resolution of the city commission.
